DUI/DUID/DWAI charges filed against man following fatal crash

One man in Colorado is believed to have caused a fatal accident due to drinking and driving. The crash took place on a recent Saturday. The individual now faces DUI/DUID/DWAI charges.

Police said a 22-year-old man was walking along a road early one morning sometime before 2 a.m. He ended up being struck by a vehicle. The man passed away at the crash scene.

Police said they believed that the driver of the car, 21, had been drag racing at the time of the collision. He allegedly left the roadway after failing to make a turn. The car reportedly ended up in the area between a nearby house's front door and garage. The driver's blood alcohol content was later determined to be 0.133. The man, who told authorities he had been drinking alcohol before driving the car, faces not only DUI charges but also traffic-related and vehicular homicide charges.

If an individual is charged with DUI/DUID/DWAI leading to death, this constitutes a felony in Colorado. A conviction on these charges may result in a person's being sentenced to years in prison. The prosecution has to prove these types of serious criminal charges beyond a reasonable doubt before a conviction can be handed down. The accused person may also be given a chance to plea bargain with the prosecution, which may lead to a lighter sentence for the individual. The person accused of drinking and driving in Colorado has the right to pursue the most personally favorable outcome in this type of criminal court case.
