Woman faces DUI charge following car accident

A woman was recently taken into custody in the state of Colorado after being involved in a motor vehicle crash. Police say that the woman was driving under the influence at the time of the accident. The alleged DUI accident took place on a Wednesday.

The collision occurred at around 11 a.m. at two street intersections. According to police, the woman was driving a minivan. She apparently attempted to make a left turn at a red light.

An SUV ended up striking the minivan. The woman was arrested for being alcohol impaired behind the wheel. The man driving the SUV suffered injuries in the crash and was transported to the hospital.

When a DUI case goes through the Colorado criminal justice system, the accused person -- alongside legal counsel -- may have the chance to negotiate a plea deal with the prosecution in exchange for lesser charges or favorable sentencing considerations. The decision of whether to accept a plea bargain -- should one be offered by prosecutors -- rests solely with the defendant. The accused individual retains the right to go to trial to fight the charge vigorously. In those circumstances, the prosecution must prove each and every element of the charge pending against the defendant -- a burden that is often challenging to meet; failure to do so must result in dismissal of the charge. Whether the client goes to trial or decides to accept a plea bargain, the criminal defense will strive to ensure that none of the client's relevant rights are violated during any stage of the criminal proceedings.
